Please carefully read this Limited Warranty ("Limited Warranty") to understand your rights and obligations regarding the "Forbidden Fruit" products. This Limited Warranty grants you specific legal rights, and you may also have other rights that vary from state to state (or by country or province). Unless allowed by law, "Forbidden Fruit" does not exclude, limit, or suspend other rights you may have. To fully understand your rights, you should consult the laws of your country, province, or state.
"Forbidden Fruit" Inc. ("Forbidden Fruit") warrants to the original purchaser that new SEXUAIFI brand hardware products and SEXUAIFI brand accessories (collectively, "SEXUAIFI Products") are free from material and artistry defects under ordinary consumer use and by the guidelines, technical specifications, and other instructions published by "Forbidden Fruit," for one year from the date of original retail purchase. At our discretion, we may change the availability of this Limited Warranty, but any changes will not be retroactive.
Should your SEXUAIFI Product exhibit a defect covered by this warranty ("Product Defect") during the warranty period, and you return your SEXUAIFI Product following "Forbidden Fruit's" instructions, "Forbidden Fruit" will at its option.
a.Repair your SEXUAIFI Product using new or refurbished parts,
b.Replace your SEXUAIFI Product with a new or refurbished SEXUAIFI Product that is at least functionally equivalent to yours or
c.Refund the entire purchase price of your SEXUAIFI Product. If we opt to repair or replace the SEXUAIFI Product, we will also cover the shipping and handling fees to return the repaired or replacement product to you. All products and parts replaced become the property of "Forbidden Fruit." Nothing in this Limited Warranty reduces or otherwise affects your statutory rights about the SEXUAIFI Products. Suppose a Product Defect arises and a valid claim is received within the warranty period, at its option and to the extent permitted by law. In that case, these are your sole and exclusive remedies. Subject to applicable law, this Limited Warranty applies for the remainder of the original warranty period or ninety days, whichever is longer, for any repaired or replacement parts or devices. All refunds and replacements become our property.
This Limited Warranty does not cover any hardware products or software, even if packaged or sold with SEXUAIFI Products. Manufacturers, suppliers, or publishers other than "Forbidden Fruit" may provide their warranties to you – please get in touch with them for further information. Software distributed by "Forbidden Fruit" with or without the SEXUAIFI brand (including, but not limited to, system software) is not covered under this Limited Warranty. Refer to the licensing agreement accompanying the software for details of your rights concerning its use. "Forbidden Fruit" is not responsible for damage arising from failure to follow instructions relating to SEXUAIFI Product's use. This Limited Warranty does not apply to
a.consumable parts, such as batteries or protective coatings, are designed to diminish over time unless failure has occurred due to a defect in materials or artistry;
b.cosmetic damage, including but not limited to scratches, dents, and broken plastic;
c.damage caused by use with non-"Forbidden Fruit" products;
d.damage caused by accident, abuse, misuse, flood, fire, earthquake, or other external causes;
e.damage caused by operating the product outside the permitted or intended uses described by "Forbidden Fruit";
f.damage caused by service performed by anyone who is not a representative of "Forbidden Fruit";
g.a SEXUAIFI Product that has been modified to alter functionality or capability without the written permission of "Forbidden Fruit";
h.If any serial number has been removed or defaced from the SEXUAIFI Product.
If "Forbidden Fruit" receives information from relevant public authorities that the product has been stolen or if you are unable to deactivate passcode-enabled or other security measures designed to prevent unauthorized access to the SEXUAIFI Product, and you cannot prove in any way that you are the authorized user of the product (e.g., by presenting proof of purchase), the SEXUAIFI Product is not covered by this Limited Warranty. "Forbidden Fruit" may, to the extent permitted by law, provide hardware identifier information to relevant authorities or registration bodies for safety and fraud prevention purposes.
To obtain warranty service, please visit www.SEXUAIFI.com/pages/warranty-service. Provide the required information and follow the instructions on www.SEXUAIFI.com/pages/warranty-service to determine if your SEXUAIFI Product requires service. If it does, ship your product for warranty service. You will be responsible for any loss or damage to the product or parts due to failure to follow instructions.
Before you deliver your SEXUAIFI Product for warranty service, you are responsible for removing any removable storage media and backing up any data, software, or other materials you may have stored or preserved on your SEXUAIFI Product. "Forbidden Fruit" and its authorized agents are not responsible for any loss, recovery, or breach of data, software, or other information on the serviced SEXUAIFI Product's storage media, databases, or any other part.
Except where prohibited by law, this Limited Warranty and the remedies set forth are exclusive, instead of all other warranties, remedies, and conditions, whether oral or written, statutory, express, or implied. "Forbidden Fruit" expressly disclaims all other warranties, including any implied warranties of merchantability and fitness for a particular purpose and any warranties against hidden or latent defects, to the extent permitted by law. If "Forbidden Fruit" cannot lawfully disclaim statutory or implied warranties, then to the extent permitted by law, all such warranties shall be limited in duration to the duration of this express Limited Warranty and to repair, replacement, or refund service as determined by "Forbidden Fruit" in its sole discretion.
Except as provided in this Limited Warranty and to the maximum extent permitted by law, "Forbidden Fruit" is not responsible for direct, special, incidental, or consequential damages resulting from any breach of warranty or condition or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, compromise, or corruption of data; or any indirect or consequential loss or damage howsoever caused including the replacement of equipment and property, any costs of recovering, programming, or reproducing any program or data stored in or used with the SEXUAIFI Product or any failure to maintain the confidentiality of information stored in the SEXUAIFI Product. The preceding limitation shall not apply to death, personal injury claims, or any statutory liability for intentional and gross negligence acts and omissions. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
No "Forbidden Fruit" dealer, agent, or employee is authorized to modify, extend, or add to this Limited Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. "Forbidden Fruit" or its successor in title is the warrantor under this Limited Warranty.
